Based on the information you have submitted, ACMA considers that the message is most likely a â^À^Ødesignated commercial electronic messageâ^À^Ù, as defined in Schedule 1 of the Spam Act 2003. For the purposes of the Act, messages sent by government bodies, registered political parties, religious organisations, charities and educational institutions are â^À^Ødesignated commercial electronic messagesâ^À^Ù if they relate to goods or services that the organisation supplies. These messages are exempted from some requirements of the Act. The Citizens Electoral Council of Australia is a registered political party and, as a result, the message is not likely to be in breach of the Act.
